This page (together with the documents referred hereto) contains the General terms and conditions (the 'Terms and conditions') for the purchase of the products (the 'Products') displayed on our website (the 'Site').

These Terms and conditions together with those contained in the order that appears during the purchase process make up this agreement. Please read these conditions carefully before using the POLO CLUB EUROPE S.L.U. services or making any purchase. Placing an order implies the acceptance of these Terms and conditions. The Terms and conditions are at customers' disposal at all times on this webpage.

1. OWNERSHIP OF THE DOMAIN www.eu.poloclub.com

The www.eu.poloclub.com domain is property of POLO CLUB EUROPE S.L.U., a registered company with VAT No. B54512512, and tax domicile at Pdta. Jubalcoi, Polígono 1, No. 90, 03295, Elche (Alicante) Spain. Customers can contact us to make comments or suggestions by email to contact@poloclub.com

2. OBJECT AND SCOPE

2.1. These Terms and conditions are intended to determine the regulation of the content and products offered to the customers who visit or buy on our Site, and the relationships established between them and the domain owner, the POLO CLUB EUROPE S.L.U. company, or those third parties that, by means of the appropriate license agreements, use the website to deal with end customers

2.2. These Terms and conditions shall apply effectively, excluding any others, to all commercial transactions relating to the products and services offered on the www.eu.poloclub.com website.

2.3. This agreement is offered in different languages, however, the Spanish version prevails. Therefore, if customers choose another language different from Spanish to execute the agreement, and in case of differences between the Spanish version of the Terms and Conditions and the version chosen, the Spanish version shall prevail.

3. COMMUNICATIONS BETWEEN THE PARTIES

3.1. Customers accept as valid the notifications and communications that POLO CLUB EUROPE S.L.U. sends by electronic means to the addresses or telephone numbers provided when opening their customer account or placing an order.

3.2. For these purposes, such electronic communications shall have full effect, except in the case of mandatory legal prescription.

4. OUR RESPONSIBILITY

4.1. The Site sells valid products in accordance with European legislation. The company declines all liability arising from the applicable legislation in countries outside Europe.

4.2. We commit ourselves to make our best efforts to guarantee the availability, within the limitations derived from the very nature of electronic commerce – remote and not in person – of all the products and services offered on the Site, with a commitment to diligence and effectiveness.

4.3. We assume no liability for (i) losses arising from circumstances which are not a direct consequence of our failure to comply with these Terms and conditions, (ii) for not meeting the expectations that customers would have subjectively made, (iii) business losses (including lost profits, actual or anticipated sales or revenues, lack of liquidity or return on capital, business with third parties, reputation, goodwill or clientele, etc.) and (iiii) indirect or consequential losses.

4.4. Likewise, POLO CLUB EUROPE S.L.U. shall not be liable for any delays or failure to comply with the obligations assumed here when these are due to causes completely beyond our diligent control or effort.

 4.5 We inform that, being an online business, we are not required by law to have complaint forms. However, customers can send us their complaints to contact@poloclub.com, and we shall process them through the channel that we have enabled for this purpose. In addition, in accordance with EU Regulation No. 524/2013, we inform that customers have the right to request an online dispute resolution (ODR) to solve consumer disputes on http://ec.europa.eu/consumers/odr/.

5. OBLIGATIONS OF CUSTOMERS OR USERS

5.1. When customers register or place an order on the Site, they shall be subject to these General terms and conditions and to the particular conditions of such registration or purchase. Placing an order implies the legally-binding acceptance of these Terms and conditions.

5.2. Similarly, when placing an order on our Site, customers ensure that they have the minimum age and legal capacity to enter into this agreement according to the applicable legislation in the territory from which they perform the contracting.

5.3. Customers shall provide complete and truthful information about their personal data necessary to process their order requests under appropriate conditions. They also undertake to notify any changes to such data as soon as they occur.

5.4. Customers are responsible for ensuring, by all reasonable means at their disposal, the security of passwords, bank details and other sensitive data of their customer account, diligently preventing third parties from accessing such data. POLO CLUB EUROPE S.L.U. is not responsible for damages arising from improper use thereof, which shall be the sole customers' responsibility.

5.5. Customers shall immediately notify POLO CLUB EUROPE S.L.U. any theft or fraudulent appropriation by third parties of such data, or the reasonable suspicion that this has occurred or may occur.

5.6. Customers shall bear the costs resulting from the inaccuracy of the details provided for delivery, or from refusing or not collecting the products duly supplied. The cost for this will be €6.95.

5.7. Customers undertake not to place any false or fraudulent order. POLO CLUB EUROPE S.L.U. reserves the right to refuse the Order if there are reasonable ground to suspect that this commitment has not been fulfilled, and to report it to the competent authorities.

6. BUYING ON THE WEBSITE www.eu.poloclub.com

6.1. Customers can purchase as a guest or as a registered customer on the Site. Registration is very simple and can be done at any time or right after filling out the purchase form as a guest. We shall only ask customers for the information needed to speed up the purchase process. The data collected shall be processed in accordance with our Privacy policy.

6.2 All orders require the acceptance of prices and characteristics of the products detailed in their sales description.

6.3. The validation of the order implies the full knowledge and acceptance of these Terms and conditions, as well as the conformity with the product, its characteristics and price.

7. PRODUCT DISPLAY AND AVAILABILITY

7.1. POLO CLUB EUROPE S.L.U. tries to display and describe the products as accurately as possible.

7.2. POLO CLUB EUROPE S.L.U.  declines any responsibility in case there is any error or omission in the display or description.

7.3. The photographs illustrating and complementing the descriptions of the products are not part of the scope of this agreement.

7.4. In case any products are not available once the order has been placed, POLO CLUB EUROPE, S.L.U. undertakes to notify customers as soon as possible, cancelling the shipment and refunding the amount of the order.

8. PAYMENT

8.1. All prices, both for product and transport services, include VAT, except when the price shall be displayed in a different way to comply with legal requirements.

8.2. The prices of the products may vary. Those published at the time of making the purchase on the Site shall apply.

8.3. Customers can choose between the different payment methods accepted on the Site.

8.4. During the purchasing process, customers may decide to pay for their purchase using KLARNA flexible payments. 8.6. Security of payments. POLO CLUB EUROPE S.L.U. uses all means to guarantee the confidentiality and security of the data transmitted through the Site. The entity issuing the cards with which the payment is made shall verify and authorise such payment. If the payment is not authorised, the agreement shall not be executed and, therefore, POLO CLUB EUROPE S.L.U. is exempt from any liability for a delay or non-delivery of the Order.

9. PROMOTIONS

Special conditions may apply to our offers. In this case, the special conditions of the offer will be published on our website, clearly stating to which product/s they apply.

10. SHIPPING

Below, we detail the order estimated delivery times and cost according to their destination.

During sale and special promotion and discount campaign periods – as well as for certain items in whose description is properly stated – standard delivery times may take between 5-7 working days and the express shipping service may not be available depending on workload.

Free shipping:

Free shipping is available only to the destinations stated and for standard shipping with some transport agencies for orders over €100. To enjoy this promotion, the customer needs to choose the specific transport agency. 

Express shipping:

For express shipping, the 24-hour delivery time begins from the moment the order confirmation email is sent.
For orders placed after 2 pm (GMT +1), the time will start counting from the next working day. 

Delivery times may increase if you cancel a product or change the delivery address once the order has been placed.  The shipping address cannot be changed once the items have been shipped.

Please note that the parcels are handled by third parties, so the specified delivery times are for guidance purposes only. Possible delays due to payment authorisations or exceptional transport conditions (exceptional weather conditions, strikes, etc.) are not considered when calculating these delivery times.

If customers, or a person authorised by them, cannot receive the Order on the date and place agreed, they shall contact POLO CLUB EUROPE SLU by email at contact@poloclub.com to agree another time for the delivery. If the order cannot be delivered at the agreed place and date, the carrier shall contact the customer to agree a new delivery date. In the event that the Order could not be delivered for reasons unrelated to POLO CLUB EUROPE SLU, the Order shall be returned to our warehouse. If, within 30 days of the attempted delivery, the customer cannot be contacted or refuses to receive the goods, the order shall be considered abandoned, and POLO CLUB EUROPE SLU reserves the right not to refund it.


11. RETURNS AND EXCHANGES

11.1 HOW TO RETURN AN ITEM

Customers have 30 days from the date they receive their order to return an item purchased in our online store. 

The return shall always be made from the territory in which the purchase was made. If not, POLO CLUB EUROPE SLU may pass the extra cost on to the customer.
All products shall be returned in their original package, with the tags on, unworn and in the same condition they were sent.

If customers choose this option, POLO CLUB EUROPE SLU puts at their disposal two return options:


- Drop off at a collection point
- Home pickup depending on the country as specified in the return platform.

To proceed with the return, customers shall click on this link and follow these steps:

1- Enter the email associated with the order

2- Go to their email inbox and click on the link received.

3- Select the order to be returned.

4- Select the item(s) to be returned.

5- Select the reason why they want to return the item(s).

6- Select the type of return: home pickup, if available depending on your country, or return at drop-off point

7- Select the type of refund: gift card or same payment method

8- Check that all the information is correct and confirm the return.

9- Download and print the return label and follow the instructions.

If customers want to modify or cancel the return request, they shall contact POLO CLUB EUROPE SL at contact@poloclub.com

By their own means.

Customers can send the items by their own means.

To do this, customers shall contact the customer service department by email at contact@poloclub.com, and get the shipping address information.

In either case, whether customers have opted for one of POLO CLUB EUROPE SLU return options or have sent the goods by their own means, once the goods have been received and the condition of the product(s) checked, POLO CLUB EUROPE SLU shall proceed to refund the corresponding amount by the method chosen by the customer (gift card or the same payment method used when they were purchased) within a period of 8-10 days after the date when the shipping confirmation email is sent.


11.2. SPECIAL RETURN CONDITIONS

Socks (2 pack, 3 pack, 5 pack)

If you want to return a pack, the original packaging and its elements shall be in perfect condition, without tears, tags removed or any other alteration. Product packs shall be returned in full, i.e. all items in the pack shall be returned together. Partial returns or of individual products that are part of a pack will not be accepted. These return conditions apply specifically to product packs that cannot be opened and returned separately.

Underwear (single pack, 2 pack, 3 pack)

For hygiene and safety reasons, whether the product has been purchased individually or in a pack, returns of underwear whose packaging has been opened or altered will not be accepted. The original product packaging shall remain in perfect condition, without tears, labels removed or any other alteration.

Pack (polo shirt, shirt, T-shirt, jumper 2 pack, 3 pack)

Partial returns or of individual products that are part of a pack will not be accepted.
In case of a partial return of a pack, the discount applied shall be cancelled. This is, if customers return some of the items of their pack (but not the whole pack), they shall lose the discount, and the price of the item(s) they keep shall be the original price (retail price without the pack discount as published on the Site when the items were purchased). The refund made for the returned piece(s) is the difference with the item’s original price.

Example:
Beige custom-fit polo shirt €60 (price without pack discount)
Beige custom-fit polo shirt €47.49 (price with pack discount)
Discount: €12.51
In case of a partial return, the promotion shall be cancelled. Therefore, the price of the piece which is NOT returned is €60. The refund is made by subtracting the discount (€12.51) from the price paid for the piece (€47.49). This is, €47.49 - €12.51 = €34.98 is the amount to be refunded.


11.3. REFUNDS

The amount of the refund shall be the same as the price for which the products returned were purchased. Please note that shipping costs are not refundable.

When POLO CLUB EUROPE S.L.U. has received the product(s) returned and checked they are in good condition, with the labels on and in the same condition they were sent (unworn and unwashed), the customer shall receive a confirmation email and the refund.

If customers made the purchase with a bank card, they can choose to have the refund sent to that same bank card or to get the refund in a gift card (credit for the shop) they can redeem at any time on the Site.

If the purchase was made with a gift card, the refund shall be made to the same gift card.

The refund to the credit/debit card shall be processed within 8-10 days of the moment the confirmation email is sent. This period may vary depending on the bank processing time, which may change according to the payment method and to each bank.

The refund in a gift card (credit for the shop) is automatically sent along with the return confirmation email from our facilities.

11.4. EXCHANGES

We only admit exchanges if the product is faulty. In other cases, for example, when the product does not meet the customers’ expectations or if they want a different size or colour, they need to return the product to get the refund, following our refund process, and then make a new purchase. The conditions and prices valid at the time the new purchase is made shall apply.

11.5. FAULTY PRODUCTS

POLO CLUB EUROPE SLU’s products are carefully inspected to ensure their quality and to detect any faults before they are sent. However, if customers receive an item that is not in perfect condition, they shall contact POLO CLUB EUROPE SLU at contact@poloclub.com, specifying the details of the product and what the problem is, and requesting the exchange of the product or a refund if that is what they prefer.

It shall be the customers’ responsibility to check that the products are in good condition when they receive it. Therefore, if the box is open or there are doubts or suspicions that the product may not be in good condition due to the appearance of the packaging, customers shall not accept it, immediately notifying POLO CLUB EUROPE SLU via the contact email contact@poloclub.com.

If the customer receives a faulty item and returns it without having previously contacted POLO CLUB EUROPE, SLU, once the item has been received and checked by the Quality Department of POLO CLUB and confirmed there is a fault or defect, the customer shall contacted to be offered either the replacement or the refund of the item, including the delivery costs paid for receiving the product and the costs paid for returning them to us, as well as, if they choose to exchange it for another product, the shipping costs of the new product.

 If customers choose to have their money refunded, they may decide to have it sent to the same bank card or to get the refund in a gift card (credit for the shop) they can redeem at any time on our Site.

If the purchase was made with a gift card, the refund shall be made to the same gift card.

 12. RIGHT OF WITHDRAWAL

12.1. Customers may cancel the order placed, without having to justify it, within 14 calendar days from the day on which customers or an appointed third party, other than the carrier, receive the last of the products of an order.

12.2.  To exercise the right of withdrawal, customers shall notify POLO CLUB EUROPE SL by email at contact@poloclub.com of their decision to withdraw the agreement by means of an unambiguous statement.

They may use the withdrawal form below, although its use is not mandatory. In order to comply with the withdrawal period, the communication relating to the exercise of the right of withdrawal shall be sent before the withdrawal period expires.

12.3. Effects of withdrawal. In case of withdrawal by customers, POLO CLUB EUROPE S.L.U. shall proceed to refund customers for the payments made, including delivery costs – with the exception of the additional costs resulting from the customers' choice of a delivery method other than the less expensive type of ordinary delivery that POLO CLUB EUROPE S.L.U. offers – without any undue delay and, in any case, no later than 14 days from the date on which customers inform of their decision to withdraw this agreement. .

12.4. POLO CLUB EUROPE S.L.U. may withhold the refund until the goods have been received, or until customers have shown proof of the return of the goods, depending on which condition is met first.

Once the condition of the products has been checked, and provided that the return conditions indicated above are met (original packaging, labels, condition) POLO CLUB EUROPE S.L.U. shall proceed to make such refund using the same payment method used by customers for the initial transaction.

13. GOVERNING LAW - JURISDICTION

13.1. These conditions are governed by Spanish law. In the event of a dispute arising from these Terms and conditions, the parties submit to the Courts according to the applicable legal regulations in the matter of competent jurisdiction, which, in the case of end customers, refer to the place of fulfilment of the obligation or to the domicile of the buying party.

13.2. In the event of a purchase made by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts of Elche (Alicante), Spain.

14. AMENDMENT OF THE TERMS AND CONDITIONS

14.1. POLO CLUB EUROPE S.L.U. reserves the right to make changes to its website, its policies and its terms and conditions at any time.

14.2. Customers shall be subject to the terms and conditions and policies in effect at the time they place their order, unless a change to those terms and conditions or policies is required by law or by public authorities (in which case, such changes may apply to any orders they have previously placed).

14.3. If any of these conditions are declared invalid, void or for any reason unenforceable, that condition shall be deemed excluded, not affecting the validity and enforceability of the remaining conditions.
